 UNAMI issues its 11th report on the situation of human rights in Iraq (10/11/2007) Baghdad, 11 October 2007--The UN Assistance Mission for Iraq (UNAMI) issued its eleventh report on the human rights situation in the country covering the period 1 April to 30 June 2007. The report recognizes the challenges confronting the Government of Iraq in the face of ongoing violence and an ever-deepening humanitarian crisis. The report states, “Having been forced to abandon their homes, many are living in dire conditions without access to adequate food supplies and basic services, with children being particularly vulnerable to disease.” It warns of growing displacement stating that, “Large-scale displacement of Iraqi civilians continued due to the ongoing violence, including direct death threats, abductions or killings, in many parts of Iraq,” and notes that the, “UN High Commissioner for Refugees (UNHCR) estimated that some 2.2 million Iraqis are currently refugees abroad, around half of whom are in Syria.”   The eleventh Quarterly Human Rights report states that civilians continue to be targeted by armed groups through suicide bombings, abductions and extrajudicial executions by perpetrators who make no distinctions between civilians and combatants. The report warns that such systematic or widespread attacks against a civilian population are tantamount to crimes against humanity and violate the laws of war, and their perpetrators are subject to prosecution.   While the security situation remains grave, the report urges the government and state institutions to do more in ensuring better judicial oversight mechanisms for suspects arrested in the context of the ongoing Baghdad Security Plan and immediately address reports of torture in Iraqi Government facilities as well as those of Kurdistan Regional Government. On the issue of military operations and allegations involving foreign security companies, the report urges that, “All credible allegations of unlawful killings by MNF forces be thoroughly, promptly and impartially investigated, and appropriate action be taken against military personnel found to have used excessive or indiscriminate force, and that the initiation of investigations into such incidents, as well as their findings, should be made public.” UNAMI also urges the US authorities to investigate reports of deaths caused by privately hired contractors, and establish effective mechanisms for holding them accountable whenever circumstances surrounding the killings show no justifiable cause. The report also emphasizes UNAMI’s concern regarding prolonged detention and the absence of timely processing of detainees’ cases through the judicial system. The overwhelming majority of detainees interviewed by UNAMI spoke of extended delays in their initial referral to a judicial official of up to two months in many cases and lack of information on what would happen next, or where and when they would be transferred and how long they would be held. As a matter of urgency, the Government of Iraq and the judicial authorities need to take all necessary measures to address these concerns, concludes the report. ----------------------------------------------------------------------

유엔 "美 작전으로 이라크인 너무 많이 피살"(종합)
사설 경호업체 총격사건 사법처리 권고 (두바이=연합뉴스) 강훈상 특파원


= 유엔 이라크지원단(UNAMI)은 11일 격년으로 발행하는 이라크 인권 보고서에서 미군의 테러조직 소탕 작전시 이라크 민간인이 너무 많이 죽고 있다고 우려를 나타냈다.    UNMAI는 또 최근 발생한 이라크 내 사설 경호업체의 민간인 총격사고와 관련, 해당국에서 사법처리를 해 책임을 물어야 한다고 권고했다.    이 보고서에 따르면 미군이 바그다드와 주변 지역을 공습하면서 4∼6월 이라크 민간인 최소 88명이 숨졌고 지상군의 소탕작전으로는 더 많은 민간인이 희생됐는데 미 당국과 계약한 사설 경호업체가 연루된 경우도 여러 건 보고됐다고 지적했다.    이 보고서는 미군의 군사작전이 이라크의 폭력사태를 막기 위해서였지만 이라크 민간인의 죽음도 초래했다며 모든 불법적 살해는 철저히 조사해야 하고 과도하고 무분별한 군사력을 동원한 군사작전도 있었다는 내용을 담았다.    UNAMI는 최근 연달아 발생한 미국 블랙워터USA와 호주의 유나이티 리소시스 그룹의 이라크인 사살 사건과 관련, 사설 경호업체의 비인도적인 민간인 공격은 전쟁범죄로서 반드시 사법처리 돼야 한다고 밝혔다.    아울러 UNAMI는 사설 경호업체 등 모든 분야의 미국 하청업체가 부당하게 이라크인에 피해를 주거나 살상하는 데 대해선 엄중히 법적인 책임을 물을 수 있는 사법 체계를 갖춰야 한다고 미국 정부에 권고했다.    이 단체는 이라크에서 영업하는 민간 업체에 면책특권을 부여한 2004년 미 임시행정처(CPA)의 훈령을 미국 정부가 폐지할 수도 있었지만 미국은 아직 그렇게 하지 않았다고 지적했다.    UNAMI는 또 민간 업체 의존도가 높아지는 것은 민간인과 전투병의 구분이 희미해지는 위험이 있다며 이라크에서 영업하는 모든 민간 기업이 국제인도법(international humanitarian law)을 존중해야 한다고 요구했다.    UNAMI의 사이드 아리카트 대변인은 "우리는 이라크에서 하청업체와 계약한 외국 정부가 법을 적용하기를 바란다"며 "절대 법을 초월하는 불량한 요소가 있어서는 안된다"고 말했다.    한편 지난 달 16일 블랙워터USA의 총격사건의 사망자 3명의 친척과 부상자 1명이 법률 대리단체인 `헌법상 권리 센터'를 통해 11일 미국 법원에 블랙워터USA를 고소했다.    이들은 소장에서 블랙워터USA가 사법관할 밖의 살해와 전쟁 범죄를 저질러 미국 실정법을 위반했으며 직원들(경호원)사이에 불법적 환경을 조성, 무고한 인명을 댓가로 회사의 경제적 이익만을 챙기도록 직원들을 독려했다고 주장했다.    이들 피해자와 가족은 또 블랙워터USA의 창업자인 에릭 프린스를 법정에서 증인으로 세워야 한다고 요구했다.    hskang@yna.co.kr (끝) 2007/10/12 03:01 송고
